1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Insights Warehouse (Pty) Ltd ("Company," "we," "us," or "our"), a South African company, governing your use of our social media analytics platform and services.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

Insights Warehouse provides a cloud-based social media analytics platform that enables users to:

• Connect and analyze social media accounts (Facebook, Instagram, LinkedIn, X/Twitter)
• Generate white-labeled PDF reports and presentations
• Access AI-powered insights and recommendations
• Schedule automated report delivery
• Customize themes, layouts, and branding

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts under South African law to use our services.

3.2 Account Registration

To access our services, you must:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your login credentials confidential
• Notify us immediately of unauthorized access
• Be responsible for all activities under your account

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. Subscription and Payment Terms

4.1 Subscription Plans

We offer various subscription plans with different features and pricing. All fees are quoted in South African Rand (ZAR) unless otherwise stated.

4.2 Payment

6. Intellectual Property Rights

All content, features, and functionality of our platform (including but not limited to software, text, graphics, logos, and designs) are owned by Insights Warehouse and protected by South African and international copyright, trademark, and intellectual property laws.

6.2 Your Content

You retain ownership of content you upload or create using our services. By using our services, you grant us a limited, non-exclusive license to process, analyze, and display your content to provide our services.

6.3 Generated Reports

You own the white-labeled reports and presentations you generate using our platform. You may use these reports for your business purposes.

7. Third-Party Services

Our platform integrates with third-party social media platforms (Facebook, Instagram, LinkedIn, X/Twitter). Your use of these integrations is subject to:

• The respective platform's terms of service and privacy policies
• Your authorization for us to access your social media data
• The availability and functionality of these third-party services

We are not responsible for changes, interruptions, or issues caused by third-party services.

8. Data Protection and Privacy

We are committed to protecting your privacy in accordance with the Protection of Personal Information Act (POPIA). Please review our Privacy Policy for detailed information about how we collect, use, and protect your personal information.

9. Service Availability and Support

9.1 Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may temporarily suspend services for:

• Scheduled maintenance
• Emergency repairs
• Security updates
• Force majeure events

9.2 Support

We provide customer support during South African business hours (SAST). Support response times vary based on your subscription plan.

10. Warranties and Disclaimers

10.1 Service "As Is"

Our services are provided "as is" and "as available" without warranties of any kind, express or implied, except as required by South African consumer protection laws.

10.2 No Warranty

We do not warrant that:

• Our services will meet your specific requirements
• Services will be uninterrupted, timely, or error-free
• Results obtained will be accurate or reliable
• Third-party integrations will always function correctly

11. Limitation of Liability

To the maximum extent permitted by South African law:

• We shall not be liable for indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
• We are not liable for losses caused by third-party services or your misuse of our platform

Nothing in these Terms excludes liability that cannot be excluded under South African law, including liability for fraud, gross negligence, or willful misconduct.

12. Indemnification

You agree to indemnify and hold harmless Insights Warehouse, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

You may terminate your account at any time by canceling your subscription through your account settings or contacting us.

13.3 Effect of Termination

Upon termination:
